RELEASE: Nebraska Appleseed Celebrates Supreme Court Upholding Birthright Citizenship

President fails to dismantle a cornerstone of the Constitution and democracy

LINCOLN, NE – Today, the United States Supreme Court issued their decision in the case of Trump v. Barbara, which challenged the constitutionality of President Trump’s outrageous  executive order to dismantle a cornerstone of our Constitution and democracy by stripping citizenship from some children born in this country. The majority of the Court ruled that Executive Order 14160 is unconstitutional.

The Court’s ruling today affirms what has long been clear: Birthright citizenship is a fundamental constitutional guarantee and a cornerstone of our democracy. 

Nebraska Appleseed’s Immigrants & Communities Program Director, Darcy Tromanhauser, issued the following statement: 

“The 14th Amendment is at the heart of our democracy and core to making us one nation. We deeply value the guarantee that all who are born here are citizens of the United States. The Constitution is clear, and today, we celebrate that the Supreme Court has confirmed that the executive order seeking to unilaterally change it is not only flatly illegal – it flies in the face of our values as a nation.

As we approach America’s 250th anniversary, we also remember our country was founded upon the idea that the whims of one person couldn’t dictate over the people. It is unacceptable that this administration has tried to use the courts to step toward authoritarianism – attacking immigrant community members and other groups while undermining constitutional rights, weakening communities’ ability to choose their own representation, and weakening the guardrails meant to protect our democracy.”
